These terms and conditions outline the rules and regulations for staying at Villa Carissa Bali. By making a reservation and staying at our villa, you agree to comply with the following terms: Please kindly read our terms and conditions:

Payment

Payment can be made by Paypal in this website and you’ll find a secure PayPal payment option, allowing you to conveniently pay with credit cards (Visa, MasterCard).

Cancellation of reservation for non-compliance: If we find or been informed by the authority that a reservation has been made and/or paid fraudulently, we will cancel the reservation.

If you are aware of fraud or unauthorized use of your Payment Method or suspect such behavior, please contact your payment provider, who may cover the resulting charges, sometimes deducting an excess.

Shorten your stay

If you decide to shorten your stay or in case of interruption of stay for any reason, you will not be entitled to any type of refund, as your stay is booked as a unit and is subject to the number of nights indicated in the contract.

No-show

Twenty four hours (24) hours after the start of the stay, if you do not show up at our offices or if you do not show up on the date on which you informed us of your arrival, the reservation will be deemed canceled and you will be not be entitled to a reduction or refund or partial on the total price of the reservation.

Terms of cancelation

For a refundable rates: Free cancellation until D-7 before check-in date at midnight (Bali time).

For a non-refundable rates: If you cancel your reservation, you will not be entitled to a refund of the amount already paid. No modifications won’t be possible. In the event of a cancellation or no-show, the prepayment amount will not be refunded.

No modifications

Reasons of force majeure such as weather conditions, epidemiological factors, public safety, air or coastal pollution, etc., can in no case lead to the total or partial refund of the amount of the reservation.

Massage package

Please note, if you select for the 1-hour massage package but are unable to utilize it, we regret to inform you that refunds or cash returns for this package cannot be provided.

Registered guests

Please note that we have the right to deny entry if the persons who show up for the stay ARE NOT the one who made the reservation, unless this was communicated prior and agreed by us. If you want to make an indirect booking using somebody else’s Airbnb account for example, (through your friend’s or family’s account, please make sure that this would be communicated with us in advance).

Only persons stipulated on the booking form or subsequently confirmed to Villa Carissa in writing by e-mail may reside at the property as guests. Please let us know of any changes as soon as possible. The number of people staying at the property, including children, must not exceed the maximum capacity stated in the property description or elsewhere, except in the case of infants (under two years old), or unless specifically authorised.

Registration requirements

When you arrive and register with us, we ask you to complete a Registration Form for all the Residents in your group over the age of 18 with full name(s), home address(es) and nationality. This is required by law. You will also be asked for your online booking reference and Identity Document(s).

Occupancy

The maximum number of guests allowed in the villa is specified in your booking confirmation. Please note that parties or events with more guests than those mentioned in the booking are not permitted.

Valuable

Personal safe is provided in the Villa. It is highly recommended to use them to store valuables such as passports, laptops, cash, travelers checks, cell phones, cameras, etc.

Any valuables left at the property are the sole responsibility of the guests. Neither Villa Carissa nor the owners nor the staff can be held responsible for any loss or damage to personal property.

Guests are advised to ensure that all doors and windows remain locked at night to avoid temptation.

Leaving the property

You must vacate the property by 12 noon and the set of keys must be returned to us by this time. Please contact us one day before your departure to organize your departure.

If you have not left the property at the time indicated, Villa Carissa may apply an additional charge of up to 1 rental day, as this delay seriously affects our cleaning and quality control procedures.

The property should be left in the same condition you found it, tidy and with no litter on the property. Otherwise, you will be charged a supplement as indicated in the special conditions of the contract, or in the event of serious damage, the corresponding amount will be deducted from the deposit.

Damage

If damage is identified, including but not limited to furniture, appliances, and fixtures or items are missing from the property after your departure, you will be charged to cover the cost of such damage.

Terms of use

If you breach these Terms of Service and/or the Check Out Terms, we will automatically terminate this Agreement and you will forfeit your Security Deposit.

a. Responsibilities of the undersigned occupant. When you book accommodation for other occupants (in addition to yourself), you become responsible for the full rental price and for any damages caused by their behavior and the behavior of all other occupants of the rented accommodation. However, legal liability rests with all occupants of the property, against whom legal action may be taken for the total damage caused by the group regardless of who actually caused said damage. The villa is not responsible for any accidents, injuries, or losses incurred during the stay.

b. Maximum number of occupants: The reservation is valid for the maximum number of occupants indicated on the reservation form and in the contract. Use of the accommodation by more than the specified number of occupants is not permitted.

c. Celebrations and Parties: Holding parties or events with more than the maximum number of occupants permitted in the accommodation is absolutely prohibited. Failure to comply with this clause will result in the total cancellation of the reservation without the right to reimbursement of the price paid. In addition, it is strictly forbidden, due to local regulations, to make noise between 10:00 p.m. and 8:00 a.m.

d. Smoking is not allowed inside the property. However, we have designated outside areas, such as the balcony, poolside, and terrace, where smoking is allowed.

e. Pets: Pets are not allowed in properties, except a guide dog.

f. Access to the property: During the stay, the accommodation is exclusively for your use. However, you are required to provide access to agency staff and other authorized persons during your stay to verify your compliance with your obligations as described in this document, to persons required to clean the swimming pool and maintain the garden and carry out repairs or to perform other tasks arising from incidents occurring at the property during your stay. In all cases, Villa Carissa staff will ring the doorbell or knock twice before entering the property and will only use the key if you do not answer the door.

g. Villa Carissa reserves the right to cancel or rescind the rental if there are threats or reasonable suspicion that you will cause serious damage to the property. We will investigate and address any guest misconduct to ensure everyone’s comfort and safety.

h. Electricity: For vacation rentals, the cost of electricity consumption is included in the rental of our properties. All occupants are requested to make responsible and reasonable use of water heater, air conditioning equipment and energy in general to avoid incurring additional costs during their stay.
It is forbidden to leave the lights and especially the air conditioning equipment on when you are not inside the property. For long-term rentals, energy consumption costs (electricity, water, gas, etc.) are the responsibility of the customer.

i. Cleaning costs: The cost of cleaning the accommodation at the end of your stay is included in the price of the reservation and is subject to the provisions. Any additional cleaning service requested during the stay will be subject to a supplement on the amount to be paid for the reservation, which must be paid before the cleaning. j. Sheets and towels: Bed linen and towels are included in the rental price, but changes of bed linen and towels during your stay are not included. Your willingness to reuse linen/towels. To do our part to help the environment, we will change your bed linens and towels after every four nights of your stay.

k. Property keys: A full set of keys will be given to you upon arrival. No additional sets of keys will be provided unless otherwise agreed. If you do not return the keys or if they are misplaced, an additional €100 or Rp 1,6 million will be charged to compensate the company and subsequent occupants for damage and inconvenience.

l. Quiet hours: 22:00 – 07:00. Respect for neighbors: It is of utmost importance to respect the privacy and tranquility of neighboring properties.

m. If there is a repair or maintenance, the landlord and the maintenance person need to enter the premises and will require an estimated amount of time to complete the necessary work.

Benefits and responsibilities

With the exception of typographical errors, the information describing the accommodation offered is given in good faith on the basis of property checks and owners’ declarations. Villa Carissa is committed to providing accommodation as described in its terms and conditions, although you understand and agree that there may be occasional changes to the contents due to regular use, such as different electrical appliances, furniture outdoor furniture or decorative objects, which are replaced. periodically.
Villa Carissa accepts no responsibility for any changes to the accommodation or its surroundings which are not directly controlled by Villa Carissa. You expressly agree that you are not entitled to claim any compensation due to any of the following anomalies which are unforeseeable and cannot be avoided by Villa Carissa:

Villa Carissa will not be liable for any errors in property descriptions made by tour operators or third party travel agencies.

1. Building works. In general, properties are privately owned and are usually located in large residential areas. Therefore, there may be unforeseen construction works in the surrounding area. Such construction work is usually carried out by owners, building contractors or government organizations with whom Villa Carissa has no relationship, so Villa Carissa has no control over such work. Therefore, when booking accommodation, you understand and agree that neither Villa Carissa nor the owners are responsible for any nuisance caused by construction work not carried out by the Accommodation Provider.

2. Satellite/Cable TV: If the description says there is satellite or cable TV in the property, this does not necessarily mean that it is possible to receive all the channels you want. The owners, mostly foreigners, have decoders that do not necessarily receive all the international channels, but only a selection of them.

3. Water, electricity and internet: Water cuts, electricity cuts and internet blackouts are not uncommon on the Costa Blanca, especially when the area receives a large number of visitors during the summer season. Municipal and/or regional authorities may decide to temporarily interrupt or restrict supplies and services due to specific construction works or exceptional situations. Villa Carissa and the owner accept no responsibility for this type of inconvenience and for the damage caused by these restrictions.

4. Accidents and thefts: Neither Villa Carissa nor the owner of the accommodation assumes responsibility for any loss, damage or injury (injury, illness, death, property damage or theft) suffered by you or your companions during your stay. By booking accommodation you agree that you are responsible for the safety and security of your own belongings and you understand that you cannot hold Villa Carissa or the property owner responsible for such incidents. To minimize potential risks, you are advised to take particular care when using the stove and pool areas, which pose additional risks to occupants. Please ensure that you properly close and lock all doors and windows in the property. These recommendations are particularly relevant when there are children and/or elderly people among the occupants.

5. Swimming pools and gardens: The maintenance, cleaning… of communal or private swimming pools and gardens is carried out by an outside company with which Villa Carissa has no relationship. Therefore, Villa Carissa cannot be held responsible for anything related to it.

6. Common facilities: The common facilities (pathway entrance to the villa, motorbike park) are managed by the community of owners therefore Villa Carissa cannot be held responsible in the event of closure or problems with these facilities. In the unfortunate event of a motorbike theft, guests are advised to ensure they have appropriate insurance coverage to address such situations. Suggestions and incident

It is important that you, as the occupier, agree and understand that some incidents occur naturally as a result of wear and tear on the property, and on some occasions they are impossible to predict (e.g. pit problems septic, boiler problems, broken faucets, electrical faults, etc.); other incidents may be beyond our control (e.g. general power outages, nearby construction, noise from neighbors or animals, insect problems, etc.).

At Villa Carissa, we will do everything in our power to resolve or minimize the impact of any incident occurring during your stay. Notwithstanding this, by booking your stay, you agree that Villa Carissa will only be responsible for matters over which it has actual control and ability to resolve during your stay, and that certain events, particularly during high season, may take longer. to solve that you. may wish, as they need the help of specialized suppliers whose availability is not guaranteed.

Third party services

Where we procure services for You through a third party (such as restaurant bookings, laundry or dry clean), all contractual arrangements relating to such services are between You and the third party.
We do not give any warranty, guarantee or other term as to the quality, fitness for purpose or otherwise of services supplied by third parties.

Do not engage in illegal activities anywhere on the property. This applies to both illegal drugs and internet activity. Please remember that you have to follow the Indonesian laws. The owner of this villa is not liable if you are engaged with the illegal activities. The Residential Tenancy Act provide that a landlord may terminate a tenancy for illegal activity that meets one or more of the following requirements:

• Has caused or is likely to cause damage to the landlord’s property.

• Has adversely affected or likely to adversely affect the quiet enjoyment, security, safety or physical wellbeing of another occupant of the residential property.

• Has jeopardized or is likely to jeopardize a lawful right or interest of another occupant or the landlord. If you get caught by the authority, the remaining balance of your stay will not be refunded. And you cannot change the date to another date. Force majeure

Villa Carissa Bali shall not be held liable for any delay, cancellation, or inconvenience caused by unforeseen circumstances or events beyond our control, including but not limited to natural disasters (e.g., hurricanes, earthquakes, pandemics), acts of terrorism, or government regulations.

Applicable right

These General Conditions and any contract to which they apply are governed in all respects by Indonesian law and only Indonesian courts will have jurisdiction to hear any claim or dispute arising therefrom or relating thereto.

Please read these terms and conditions carefully before making a reservation or staying at Villa Carissa. By booking or staying at the villa, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

Entire agreement

These Terms and Conditions constitute the entire agreement between you and Villa Carissa relating to your reservation.

Terms and Conditions for Long Term Rental at Villa Carissa, Seminyak Center

Furthermore, alongside the aforementioned Booking Terms and Conditions for Staying at Villa Carissa, the following additional terms and conditions shall also be enforced:

  1. Booking Confirmation: To secure your long-term stay, a deposit of 50% is required. This is non-refundable in case of cancellation.Deposit: 50% of the total rental amount, due upon booking. Remaining balance: 50% of the total rental amount, due upon signing the rental agreement.
  2. Rental Period: The minimum rental period is [number] months.
  3. Monthly Rent: The monthly rent for Villa Carissa is [amount in Indonesian Rupiah]. This includes [list of inclusions, e.g., utilities, cleaning].
  4. Security Deposit: A security deposit of [amount] is required upon booking confirmation. The Security Deposit shall be refunded to the Tenant within 1 month following the end of the Rental Period, minus any deductions for damages or unpaid charges. The deposit will be given back by bank transfer to the account mentioned in the contract.
  5. Rent payment: Payment will be made in Indonesian Rupiah (IDR) and in full upon booking.
  6. Early termination of the rental agreement: If the Tenant terminates the rental agreement early, the Tenant will not be refunded, nor change to another dates, nor transferrable to another person or entity.
  7. Utilities: Water and electricity charges are included in the monthly rent, up to a reasonable usage limit. Excessive use may incur additional charges. Electricity usage exceeding the allocated allowance of IDR 4,000,000 may result in additional charges. Any overage beyond this limit will be invoiced for the difference, and you will receive a detailed bill as proof of the incurred charges.
  8. Usage of the villa: The villa is intended for residential occupancy only and must not be used for any commercial, organizational, professional, or business activities. Any violation of this restriction shall constitute a material breach of the rental agreement and may result in immediate termination of the agreement.
  9. Tenant Maintenance: Tenant will have 10 days to see if there’s something broken and not working upon check-in. If the tenant doesn’t report it within 10 days, the landlord will not be responsible for the damages or repairs. The tenant is responsible for basic maintenance, such as keeping the villa clean and reporting any issues promptly.
    • Maintain cleanliness and safety: Keep your living space clean and safe, considering its current condition.
    • Dispose of waste properly: Throw away garbage, rubbish, and waste in a way that doesn’t create a mess or pose a hazard.
    • Keep plumbing fixtures clean: Keep sinks, toilets, and other plumbing fixtures in as good a condition as possible.
    • Use facilities responsibly: Operate electrical, plumbing, heating, and other systems correctly. If there’s an elevator, use it safely.
    • Repair damages: If you accidentally break or damage something, it’s your responsibility to fix it.
    • Report issues: Like in many places, if you notice anything broken or dangerous, let your landlord know promptly.

  10. Landlord Maintenance: landlord is responsible for the following:
    • For the purpose of regular air conditioning maintenance, we will schedule timely visits to the villa. Rest assured, we will make every effort to ensure minimal disruption to your stay.
    • Structural Repairs: This includes major repairs to the property’s structure, such as the roof, walls, foundation, and any other load-bearing elements.
    • Plumbing and Electrical Systems: Landlords are responsible for ensuring that plumbing and electrical systems are in good working order. But for clogging because of waste such as tampon, baby wipes, or other foreign objects, the tenant is responsible for repairs.
    • Heating and Cooling Systems: The landlord shall maintain the heating and cooling systems in good working order and shall conduct regular inspections and maintenance at least twice a year to ensure their proper functioning.
    • Common Areas: If the property has common areas (path way to the villa), the landlord is responsible for their maintenance.
    • Appliance Repairs: If the property is rented with appliances, the landlord is responsible for their maintenance and repair. But if tenant is breaking them or causing damage due to misuse or negligence, the tenant may be held responsible for the repairs or replacement. It’s crucial for both parties to communicate and document any issues related to appliances to avoid disputes. This way, everyone understands their responsibilities.
    • Lawn and Yard Maintenance: A yard or garden, the landlord is responsible for its upkeep.
    • Pest Control: Landlords are responsible for dealing with pest infestations, unless they are caused by the tenant’s actions.
    • Safety and Security: This includes making sure that locks, windows, and other security features are in good working order.
  11. Accessories and Appliances: Any loss or damage to accessories, appliances, or furniture will be deducted from the security deposit.
  12. Insurance: It is recommended that tenants have their own insurance to cover personal belongings and liabilities during the rental period.
  13. Subletting is strictly prohibited under any circumstances: The Tenant shall not rent out or allow the villa to be used by any third party without prior written consent from Villa Carissa. Any violation of this provision shall constitute a material breach of these Terms and Conditions, and Villa Carissa may terminate the rental agreement immediately and pursue any other legal remedies available.
  14. Termination of Rental Agreement: If the Tenant wishes to terminate the rental agreement early, the Tenant will not be refunded, nor change to another dates, nor be transferable to another person or entity.
  15. Community Rules: The tenant must adhere to any rules or guidelines set by the community of owners.
  16. Liability: Villa Carissa and its owners are not responsible for any accidents, injuries, or loss of belongings during the rental period.
  17. Pets: Pets are not allowed in the villa without prior approval.
  18. Illegal Activities: The Tenant agrees not to use the villa or its premises for any illegal activities, including but not limited to drug use, prostitution, or gambling. Any violation of this provision shall be considered a material breach of these Terms and Conditions, and Villa Carissa may immediately terminate the rental agreement and pursue any other legal remedies available.

    Furthermore, if the Tenant is caught by the authority engaging in any illegal activities while staying at the villa, the remaining balance of the rental period will not be refunded. The Tenant will also be responsible for any fines or other legal fees incurred as a result of the illegal activity.

Entire Agreement

These Terms and Conditions constitute the entire agreement between Villa Carissa and the Tenant with respect to the long-term rental of Villa Carissa.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
